Probate

When a loved one passes away, legal responsibilities often follow. Sometimes they are immediate, and other times it requires a more precise review into a complex estate. Probate is the court-supervised process used to confirm one’s authority to act on behalf of a deceased person’s estate. Those actions include sending notices, transferring and/or distributing assets to heirs in an orderly and lawful way, and ensuring the estate is handled properly and in accordance with the law.

Our firm can assist with the appointment of executors, administrators, and families who need structured guidance through the probate process. We also focus on moving matters forward with careful preparation and organized documentation at each stage.

Probate can be complicated, but not always. Most often, the matters that need to be resolved through probate are procedural. The court requires specific filings and supporting documents, and the timelines vary by the type of estate, the assets involved, and the court’s rules.

During your consultation, we can review what has occurred so far (if anything), identify what is required next, and outline a path forward based on the documents available.

We may assist with initiating probate, preparing and filing probate pleadings, obtaining court authority (such as Letters Testamentary or Letters of Administration), and advising the personal representative as estate administration progresses.

If issues arise that fall outside of a routine probate administration, such as contested matters or litigation, the attorney will discuss those with you independently to assess the scope.

You do not have to navigate this process alone. The goal is not to make probate feel overwhelming, but to handle it correctly, in sequence, and with steady progress.

To begin, you may request a consultation to review the estate’s documents and determine the next required steps. If you would like to prepare in advance, we recommend downloading the Probate Intake Checklist on our Resources page before scheduling.
